Terms of Service
Last updated: May 2026
These Terms of Service ("Terms") govern your access to and use of the Epic Trail Adventures website at epictrailadventures.com and all expeditions, services, and content offered by Epic Trail Adventures, LLC ("Epic Trail Adventures," "we," "us," or "our"). By using our site or booking a trip, you agree to these Terms. If you do not agree, do not use our services.
1. Eligibility
You must be at least 18 years old to book an expedition. Minors are welcome to join on trips when booked and accompanied by a parent or legal guardian who accepts responsibility on their behalf.
2. Bookings & Payment
- A booking is confirmed only when payment (deposit or full amount) is successfully processed and you receive a confirmation email from us.
- For deposit bookings, the remaining balance is due no later than 30 days before the trip start date unless we agree otherwise in writing. Failure to pay the balance on time may result in cancellation and forfeiture of the deposit.
- All prices are listed in U.S. dollars. We may update prices at any time, but changes will not affect bookings already confirmed.
- Payments are processed by Stripe; you are subject to Stripe's own terms in addition to ours.
3. Cancellations & Refunds
- By you, 60+ days before departure: full refund minus a 5% administrative fee.
- By you, 30–59 days before departure: deposit forfeited; any balance paid is refunded.
- By you, fewer than 30 days before departure: no refund. We strongly recommend trip-cancellation insurance.
- By us: if we cancel a trip for any reason (weather, permits, insufficient enrollment, guide illness), you will be offered a full refund or the option to transfer to a different date.
4. Assumption of Risk
Hiking and backcountry travel in the American Southwest involve inherent risks, including but not limited to: extreme heat, cold, sun exposure, dehydration, falling, rockfall, flash floods, wildlife encounters, altitude effects, remote terrain with limited communications, and delayed access to emergency medical care. You acknowledge that you have read and understood these risks, that you are participating voluntarily, and that you accept full responsibility for any injury, illness, loss, or damage you may suffer.
Before any guided trip, you will be required to sign a separate Participant Agreement and Release of Liability. The provisions of that document are incorporated into these Terms by reference.
5. Health & Fitness
You are responsible for honestly disclosing any medical conditions, medications, allergies, or fitness limitations that may affect your safety or the safety of the group. We reserve the right to deny participation or to remove a participant from a trip if, in our reasonable judgment, they are not fit to continue safely. In that case, refunds are not guaranteed.
6. Conduct on Expeditions
You agree to follow your guide's instructions, respect other participants, public land regulations, and the seven Leave No Trace principles. Behavior that endangers others, damages the environment, or substantially disrupts the trip, including intoxication in the field, may result in immediate dismissal without refund.
7. Permits, Closures & Itinerary Changes
We operate under permits issued by the National Park Service, Bureau of Land Management, U.S. Forest Service, and other agencies. Itineraries are subject to change due to weather, trail conditions, permit availability, public safety closures, or any other circumstance that we determine, in our sole discretion, makes a change advisable.
8. Photography & Likeness
We may take photographs and video during trips for marketing, social media, and editorial purposes. By participating, you grant Epic Trail Adventures a non-exclusive, royalty-free license to use your likeness in those materials. If you prefer not to be photographed, tell your guide at the start of the trip and we will respect that request.
9. Intellectual Property
All content on this site, including text, photographs, maps, GPX files, logos, and the Epic Trail Adventures name, is owned by us or our licensors and is protected by U.S. and international copyright laws. You may not reproduce, redistribute, or create derivative works without our written permission, except for personal, non-commercial use of downloadable trail data on your own devices.
10. Third-Party Services & Links
Our site links to and integrates with third-party services such as Stripe, Supabase, Resend, Google, and external trail resources. We are not responsible for the content, policies, or practices of those third parties.
11. Disclaimers
Our website and all information on it are provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the site will be uninterrupted, error-free, or free from viruses or other harmful components. Trail descriptions, distances, elevations, and GPX files are provided for planning convenience and may not reflect current conditions on the ground.
12. Limitation of Liability
To the maximum extent permitted by law, Epic Trail Adventures, its officers, employees, and guides will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the site or participation in our expeditions. Our aggregate liability for any claim arising from or related to these Terms or any expedition is limited to the amount you paid us for that expedition.
13. Indemnification
You agree to indemnify and hold harmless Epic Trail Adventures from any claim, demand, or expense (including reasonable attorneys' fees) arising out of your violation of these Terms, your violation of any applicable law, or your conduct on an expedition.
14. Governing Law & Disputes
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your participation in an expedition will be resolved exclusively in the state or federal courts located in Coconino County, Arizona, and you consent to the jurisdiction of those courts.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will post the new Terms here and update the "Last updated" date above. Your continued use of the site or participation in trips after changes take effect constitutes acceptance of the revised Terms.
